1. Acceptance of Terms

By accessing and using SmileCraft® Design Studio ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

These Terms constitute a legally binding agreement between you and SmileCraft®.

2. Description of Service

SmileCraft® provides a cloud-based dental design platform that enables dental professionals to:

  • Submit patient cases with clinical photos, 3D scans, and videos
  • Receive professional smile designs and veneer designs
  • Access design deliverables and case history
  • Manage practice profile and subscription

3. User Accounts and Registration

3.1 Account Creation

To use SmileCraft®, you must create an account by providing accurate and complete information including:

  • Full name and professional credentials
  • Practice name and location
  • Professional registration number
  • Contact information (email and phone)

Upon registration, you will be assigned a unique Doctor ID (e.g., UKJS301124) based on your country, initials, and registration date. Each case you submit will receive a Case ID combining your Doctor ID with patient initials and the submission date (e.g., UKJS301124-AB-021224).

3.2 Professional Use Only

SmileCraft® is intended for use by licensed dental professionals only. By creating an account, you represent and warrant that:

  • You are a qualified and licensed dental professional
  • You have the authority to provide dental care in your jurisdiction
  • You will use the Service solely for professional purposes
  • All information you provide is accurate and up-to-date

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use or security breach
  • Ensuring your contact information remains current

4. Patient Data and Privacy

4.1 Data Controller Responsibilities

You acknowledge that you are the Data Controller for all patient data you upload. You are responsible for:

  • Obtaining all necessary patient consents before uploading any patient information
  • Ensuring patient data is de-identified where required by applicable law
  • Complying with all applicable data protection laws in your jurisdiction (GDPR, HIPAA, etc.)
  • Using only patient initials or codes, not full names, in case submissions
  • Maintaining patient confidentiality

4.2 Data Storage and Transfer

By using SmileCraft®, you acknowledge and consent to the following:

  • All patient data uploaded will be stored on servers located in the United States
  • Data will be encrypted in transit (TLS 1.3) and at rest (AES-256)
  • Case files will be securely transmitted to our SmileCraft® Design Hub for processing
  • Our design team will only see your Doctor ID (e.g., UKJS301124) and Case ID (e.g., UKJS301124-AB-021224), not your personal identifying information
  • Files will be automatically deleted 90 days after case completion

4.3 Data Processing Agreement

If you are subject to GDPR or similar data protection regulations, we offer a Data Processing Agreement (DPA) that outlines our mutual obligations.

5. Service Usage and Acceptable Use Policy

5.1 Permitted Use

You may use SmileCraft® to:

  • Submit cases for dental design services
  • Receive and download design deliverables
  • Manage your practice profile and subscription
  • Access historical case data within the retention period

5.2 Prohibited Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer or attempt to extract source code
  • Resell or redistribute the Service without permission
  • Upload data that violates third-party rights
  • Use automated systems to scrape or data mine
  • Impersonate another user or professional

5.3 Content Quality Standards

To receive the best design results, you should provide:

  • High-quality clinical photos (proper lighting, focus, framing)
  • Accurate 3D scans in compatible formats (STL, PLY)
  • Clear instructions and design preferences
  • Complete patient information (initials/codes, not full names)

6. Subscription and Payment Terms

6.1 Subscription Tiers

SmileCraft® offers multiple subscription options:

  • Pay-Per-Case: Pay only for the cases you submit
  • Pro Plan: Monthly subscription with discounted per-case rates
  • Growth Plan: Higher volume with additional benefits
  • Elite Plan: Unlimited cases with priority service

6.2 Payment Terms

  • All fees are charged in USD unless otherwise stated
  • Subscription fees are billed monthly or annually in advance
  • Per-case charges are billed upon case submission
  • Payment methods include credit card and direct debit
  • All prices are subject to applicable taxes

6.3 Refunds and Cancellations

  • Subscription fees are non-refundable except as required by law
  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • Refunds for individual cases may be granted at our discretion if service quality issues occur

7. Intellectual Property Rights

7.1 Your Content

You retain all rights to the patient data and clinical materials you upload. By using the Service, you grant us a limited license to process this data solely for the purpose of providing design services.

7.2 Design Deliverables

Upon full payment, you receive a perpetual, worldwide, non-exclusive license to use the design deliverables for your patient's treatment. You may not:

  • Resell or redistribute the designs to third parties
  • Use the designs for purposes other than treating your patient
  • Claim the designs as your own original work

7.3 SmileCraft® Platform

All rights to the SmileCraft® platform, including software, algorithms, trademarks, and branding, remain the exclusive property of SmileCraft®.

8. Liability and Professional Responsibility

Important Professional Notice

8.1 Design Services Are Advisory Only: SmileCraft® provides design services to assist in treatment planning. All designs are advisory and subject to your professional judgment. You are solely responsible for:

  • Final treatment decisions and patient outcomes
  • Clinical assessment and treatment planning
  • Verifying designs meet your patient's specific needs
  • Compliance with professional standards in your jurisdiction

8.2 No Medical Advice: SmileCraft® does not provide medical or dental advice. Our designs are technical tools to support your professional practice.

8.3 Limitation of Liability: To the maximum extent permitted by law, SmileCraft® shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or patient treatment outcomes.

8.4 Maximum Liability: Our total liability shall not exceed the fees paid by you for the specific case in question.

9. Termination

9.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support. Upon termination:

  • Your subscription will be cancelled at the end of the billing period
  • You will retain access to completed designs for 90 days
  • All data will be deleted according to our retention policy

9.2 Termination by Us

We may terminate or suspend your account if you:

  • Violate these Terms of Service
  • Fail to pay fees when due
  • Engage in fraudulent or illegal activity
  • Misuse the Service or violate professional standards

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or through the platform. Your continued use of the Service after changes take effect constitutes acceptance of the new terms.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation if negotiation fails
  3. Binding arbitration if mediation is unsuccessful
